सूचना आयोग के आदेशों को न मानने वाले बैठेगें आयोग की कुर्सी पर

उत्तराखंड में मुख्य सूचना आयुक्त के लिए लाॅबिंग शुरू हो गई है वरिष्ठ नौकरशाह शत्रुघ्न सिंह के नाम पर सहमति बन चुकी है सूत्रों के अनुसार इनका नाम राजभवन भेजा जा रहा है वहीं मुख्य सूचना आयुक्त को लेकर दावेदारों की लंबी फौज इधर से उधर पड़ रहे दबाव से उलझन में है लेकिन इसी बीच मुख्य सूचना आयुक्त पद पर अगर शत्रुघ्न सिंह काबिज होते है तो राज्य के सूचना अधिकार अधिनियम पर आम आदमी को सूचनाएं कैसे मिलेगी क्योंकि सरकार के कारनामें को राज्य के मुख्य सचिव कैसे दे पाएंगे। उत्तराखंड के किसी भी ब्यूरोक्रेट को न बैठाया जाए क्योंकि वह सरकारी तंत्र से जुड़ा होता है अपनी सैंटिंग गैंटिंग के जरिए मुख्य सूचना आयुक्त के पद पर कैसे बैठ सकता है ।

सूचना अधिकार अधिनियम के पारदर्शीता के लिए ब्यूरोके्रट ही क्यों, अक्सर देखा गया है कि सूचना अधिकार अधिनियम के तहत लोगों को पूर्ण सूचनाएं नहीं मिल पाती है जबकि इसमें वरिष्ठ अधिकारी को लोक सूचना अधिकारी का कार्यभार होता है लेकिन बड़ें अधिकारी अपना पल्ला झड़ने के लिए छोटे अधिकारी के गले पर घंटी बांध देते  है जिससे यह होता है कि लोगों का पूर्ण सूचनाएं मिल पाती है और वह अधिकारी दण्ड देकर अपना पल्ला झाड़ देते  है लेकिन अब यह सवाल उठता है कि राज्य के मुख्य सचिव शत्रुघ्न सिंह मुख्य सूचना आयुक्त बनते है तो इसपर भी सवाल खड़े होते है कि अभी मुख्य सूचना आयुक्त ने तीन बार प्रदेश के मुख्य सचिव को बुलाया था लेकिन वह नहीं पहुंचे।

शंखनाद सूत्रों के अनुसार सूचना आयुक्त ने प्रदेश के मुख्य सचिव शत्रुघ्न सिंह को निजी पत्र लिखकर भी अवगत कराया। लेकिन अब सवाल यह उठता है कि जिस सूचना अधिकार के जरिए पारदर्शी नीति के बात करते है और बड़े पदों अधिकारी बैठे हों और उन्हें सूचना आयुक्त पत्र लिखकर बुला रहा हो और अब उनकी ही ताजपोशी सरकार कर रही हो तो यह सवाल खड़े करने वाला है कि जो आदमी सूचना आयुक्त के निजी पत्र पर भी नहीं जा पा रहा हो अगर वह अधिकारी मुख्य सूचना आयुक्त बन गया तो क्या उनसे अपेक्षा की जाती है कि लोगों को पूर्ण सूचनाएं मिल पाएगी ?

हल्द्वानी निवासी चन्द्रशेखर करगेती ने प्रधानमंत्री भारत सरकार मुख्यमंत्री हरीश रावत, राज्यपाल उत्तराखंड, नेतापक्ष अजयभट्ट, मंत्री प्रसाद नैथानी और प्रिसिपल सैकेटरी, जनरल एडमिनिस्ट्रेशन डिपामेंट को डाक व मेल द्वारा शिकायत दर्ज की है कि अगर मुख्य सचिव शत्रुघ्न सिंह सूचना आयुक्त के पत्र के बुलावे पर कोई संज्ञान नहीं लेता है तो अगर जब शत्रुघ्न सिंह मुख्य सूचना आयुक्त की कुर्सी पर बैठेगें तो राज्य के सूचना अधिकार अधिनियम का बंटाधार होना तय है लेकिन अभी सिर्फ शिकायत ही दर्ज की है लेकिन इस शिकायत पर क्या संज्ञान होगा यह भविष्य के गर्भ में है लेकिन शत्रुघ्न सिंह की गिनती ईमानदार अधिकारियों में की जाती है। अपुष्ट सूचनाओं व अखबारी कतरनों के हिसाब से शत्रुघ्न सिंह राज्य के अगले मुख्य सूचना आयुक्त बन सकते है।

Hon’ble sir,
By way of this representation the applicant wants to
bring some most relevant and important facts in you kind knowledge
with regard to the appointment of State Chief Information commissioner
and Information commissioner in the state of Uttarakhand as follows :-

1. That the applicant is a practicing advocate with the bar council of
uttarakhand and RTI Activist and a public spirited person having due
regards to the law and order.

2. That applicant has filed a writ petition (PIL) No. 158 0f 2016 on
dated 24-10-2016 before Hon’ble High Court of Uttarakhand with the
following prayers :-

i. Issue a writ, order or direction in the nature of mandamus
commanding the Respondents to immediately fill the vacant post of
State Chief Information Commissioner from the suitable persons as
required under Sec.15(5) of the Act.

ii. Issue a writ, order or direction in the nature of mandamus
commanding the Respondents to ensure that the appeals under Se.19(3)
of the Right to Information Act, 2005 are heard and decided by the
State Information Commission comprising of more than one member as
required under Sec.15(2) of the Act.

iii. Issue a writ, order or direction in the nature of mandamus
commanding the Respondents to ensure that as far as possible the
appointment of a retired bureaucrat should be avoided on the post of
State Chief Information Commissioner.

iv. Issue any other suitable Writ, Order or Direction which this
Hon’ble Court deems fit and proper in the facts and circumstances of
the case.

v. To award the cost of the petition in favor of the petitioner.

3. That after the aforesaid petition was listed on 26-10-2016 for
hearing before the division bench of Hon’ble High court in which the
learned Advocate General of the state appraised the court that the
meeting of appointment committee is being to be held on dated
27-10-2016. After herring arguments of the both side the Hon’ble Court
was pleased to list the petition on 28-11-2016.

4. That the applicant came to know from the daily news paper Hindustan
(Hindi) dated 29-10-2016 that the appointment committee has approved
the name of present Chief Secretary of the state of uttarakhand namely
Mr. Shatrughan Singh for the post State Chief Information
Commissioner. It is relevant to mentioned here that despite the said
act of the selection committee is still under challenge before the
Hon’ble High Court of Uttarakhand approved the name of the bureaucrat
of uttarakhand. The photocopy of the extract of newspaper dated
29-10-2016 is being annexed herewith and marked as Annexure no.1 to
this representation.

5. That the material facts which the applicant wants to demonstrate is
that the present Chief Secretary Mr. Shatrughan Singh of state of
uttarakhand who’s name has been finalized by the selection committee
is not a suitable person for the said post for the reason that at
present there are two complaints against him under the RTI Act are
still pending before the Hon’ble information commission of
uttarakhand. The numbers of above said complaints are 10566 and 11471.

6. That Mr. Shatrughan Singh neither complied nor took any suitable
step in compliance of order passed by the Hon’ble Information
Commission in complaint number 10566 on dated 09-03-2016, 20-05-2016
and 04-07-2016. It is worthy to mentioned here that after sufficient
service of orders passed by Hon’ble Commission no action was taken by
Mr. Shatrughan Singh till date. It is a deliberate inaction and
flouting of orders passed by Hon’ble Information Commission of
Uttarakhand by the present chief secretary of uttarakhand.

7. That the another deliberate inaction and flouting of orders passed
by Hon’ble Information Commission by the present chief secretary Mr.
Shatrughan Singh in the Appeal No. AD(D)-16091, 16092, 16095 of 2014
on dated 10-03-2016, hence the complaint No.11471 under RTI ACT filed
by the applicant against Mr. Shatrughan Singh. It is worthy to mention
here that the sufficient service of the notice upon the present chief
secretary neither he appeared in person nor through any
representative before the Hon’ble Commission on date fixed for
hearing, it is shows the deliberate negligent act on the part of
present chief secretary Mr. Shatrughan Singh which cannot be accepted
in any manner.

8. That it very surprising that the name of a person who is such a
negligent and careless towards a quasi-judicial forum having no
regards and respect is being appointed for such respectable and non
biased post which secures the fundamental right of the citizen
guaranteed under Article 19 of the constitution of India in the form
of RTI ACT. There is no hope that right of citizens will be secure if
such a person is appointed on the post State Chief Information
Commissioner and State Information Commissioner.

9. That the selection committee has also ignored this relevant aspect
that the matter is still pending consideration before the Hon’ble High
Court of Uttarakhand. Therefore the state Govt. may also directed to
appoint such a person on the post of State Chief Information
Commissioner having highly esteem and who should be low abiding
citizen as well.

10. That the Preamble to The Constitution of India is therefore a
reflection of the expectation of the people of India from the State
and the State while fulfilling these expectations is required to
ensure transparency in its administration and functioning. A vibrant
democracy like ours needs an informed citizen which is vital for the
accountability and transparency in the functioning of any public
authority and also for a check on the possibility of any form of
corruption which is likely to creep in due to the decisions being
taken behind closed doors in the corridors of power.

11. That another surprising trend being noticed in the State of
Uttarakhand is during the appointment to the post of the State Chief
Information Commissioner which has become a dumping ground for retired
bureaucrats who are rewarded for their “Loyalty” to the State
Government. That when the appointment itself is a reward for loyalty
then the fairness and credibility of such appointee itself becomes
doubtful.

It is therefore most respectfully prayed that his
Excellency will take the note of the matter and make kindly be
pleased to do needful in interest of justice and to secure the right
of citizen as well.
